Terms for using HabitHone.

Agreement to These Terms

These Terms of Service ("Terms") govern your access to and use of the HabitHone website, mobile applications, and related services, including any future services, features, integrations, application programming interfaces, or tools offered under the HabitHone brand (collectively, the "Service").

HabitHone is owned and operated by an individual owner. In these Terms, "HabitHone," "we," "our," or "us" refers to HabitHone and its owner.

By creating an account, accessing the Service, or using HabitHone, you agree to these Terms and to our Privacy Policy. If you do not agree, you should not use the Service.

Eligibility

You must be at least 13 years old to use HabitHone.

If you use the Service on behalf of another person, organization, household, or child through a Cadet profile or similar feature, you represent that you have the legal authority or appropriate permission to do so.

You are responsible for ensuring that your use of HabitHone is lawful in the place where you live or access the Service.

Accounts and Usernames

You may need to create an account to use certain features of HabitHone. You are responsible for maintaining the security of your account and for activity that occurs under your account.

HabitHone currently supports Google Sign-In and may add additional authentication providers, such as Sign in with Apple, in the future.

Each account may include a unique username selected by the user. Other users may search for you by your username. Users may also choose to allow other users to find them by email address for the purpose of connecting as accomplices. Email address discovery is optional and disabled by default.

We reserve the right to refuse, reclaim, or change usernames that are offensive, misleading, inactive for an extended period, infringe another person's rights, impersonate someone else, or otherwise interfere with the Service.

Subscription Services

HabitHone offers premium subscription options. Premium subscriptions may provide access to additional features, services, tracking tools, content, limits, storage, social features, or other benefits.

Subscriptions are billed through the applicable app marketplace or payment provider. Subscription terms, renewal rules, cancellation options, free trials, refunds, and billing disputes are generally governed by the policies of the platform or payment provider through which you subscribe.

Subscriptions automatically renew unless canceled through the applicable app marketplace or payment provider before the renewal date. You are responsible for canceling a subscription if you do not want it to renew.

Subscription pricing, features, and availability may change over time. Any pricing changes will apply only after notice and as permitted by the policies of the applicable platform.

User Content

HabitHone allows users to create, store, and share content, including habits, routines, targets, to-do items, Cadet profiles, comments, highlights, reactions, photos, progress information, and custom settings ("User Content").

You retain ownership of the User Content you create or upload. By using the Service, you grant HabitHone a limited, non-exclusive, worldwide license to host, store, process, reproduce, display, transmit, and otherwise use your User Content as reasonably necessary to operate, provide, improve, secure, and support the Service.

You are responsible for your User Content and for ensuring that you have the rights and permissions needed to submit it to HabitHone. You agree not to upload or share content that violates another person's rights, violates the law, or violates these Terms.

When you choose to share highlights, comments, progress, or other information with accomplices or other users, you are responsible for the audience you select and the information you make visible.

Community Expectations

HabitHone exists to help people support one another in building meaningful habits, developing productive routines, and achieving personal goals. We encourage users to create a positive, respectful, and encouraging community.

When using the Service, you agree not to:

• Harass, threaten, intimidate, bully, or abuse other users.
• Share content that is unlawful, defamatory, fraudulent, obscene, or otherwise inappropriate.
• Impersonate another person or misrepresent your identity.
• Attempt to gain unauthorized access to another user's account or information.
• Use the Service to distribute spam, malicious software, or unsolicited commercial messages.
• Interfere with the operation, security, or reliability of the Service.
• Use the Service in any manner that violates applicable law.

HabitHone reserves the right to remove content, restrict features, suspend accounts, or terminate accounts that violate these Terms or otherwise interfere with the intended purpose of the Service.

Content Review and Moderation

Most information stored within HabitHone is private or shared only with the audience selected by the user. HabitHone does not routinely monitor private user content.

However, we reserve the right to access, review, investigate, or preserve user content and account activity when reasonably necessary to:

• Investigate reports of harassment, abuse, fraud, or other misconduct;
• Enforce these Terms;
• Respond to legal requests or comply with applicable law;
• Protect the security or integrity of the Service;
• Protect the rights, safety, or property of HabitHone, our users, or others; or
• Diagnose or resolve technical issues affecting the Service.

Any such access will be limited to what we reasonably determine is necessary under the circumstances.

Cadet Accounts

HabitHone allows users to create and manage Cadet profiles for individuals whose progress they wish to monitor or support, including children.

The account holder creating or managing a Cadet profile represents that they have the legal authority or appropriate permission to provide information about that individual and to manage that profile within the Service.

Cadet profiles are managed through the account holder's account and do not create an independent agreement between HabitHone and the individual represented by the Cadet profile.

Account holders are responsible for determining what information is entered into Cadet profiles, who may access that information, and how it is shared with others.

Behavioral Autonomy

HabitHone is designed to help users intentionally monitor and shape their own behavior through self-monitoring, goal setting, reminders, feedback, and social support.

Users remain solely responsible for the decisions they make and the actions they take while using the Service. HabitHone provides tools intended to support personal growth and habit development but does not guarantee any particular behavioral, educational, athletic, financial, professional, medical, psychological, or personal outcome.

Nothing within the Service should be interpreted as medical, psychological, psychiatric, legal, financial, or other professional advice.

Changes to the Service

HabitHone is an evolving platform. We may add, modify, replace, or discontinue features, tracking methods, scoring systems, streak calculations, achievements, social features, subscription benefits, or other aspects of the Service at any time.

Although we will make reasonable efforts to preserve user data and progress whenever practical, we cannot guarantee that every historical statistic, streak, achievement, badge, or feature will remain unchanged following updates.

We strive to provide reliable service, but we do not guarantee that HabitHone will always be available, uninterrupted, secure, or error-free.

Suspension and Termination

You may stop using HabitHone at any time. You may also request account deletion as described in the Privacy Policy or within the Service when that feature is available.

We may suspend, restrict, or terminate your access to the Service if we reasonably believe that you have violated these Terms, created risk for HabitHone or other users, used the Service unlawfully, or interfered with the operation or purpose of the Service.

Some provisions of these Terms will continue to apply after your account ends, including provisions related to user content licenses, disclaimers, limitation of liability, governing law, and any unpaid obligations.

Privacy

Our collection, use, storage, and sharing of information is described in our Privacy Policy. By using HabitHone, you also agree to the practices described in that policy.

HabitHone Intellectual Property

The Service, including the HabitHone name, design, software, interface, logos, graphics, text, and other materials provided by HabitHone, is owned by HabitHone or its licensors and is protected by intellectual property and other laws.

These Terms do not give you ownership of the Service or permission to use HabitHone's branding except as necessary to use the Service as intended.

Disclaimers and Limitation of Liability

The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, HabitHone disclaims all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent permitted by law, HabitHone and its owner shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from or relating to your use of the Service.

You acknowledge that your use of HabitHone is at your own risk and that no software or online service can guarantee uninterrupted availability, complete accuracy, or freedom from errors.

Governing Law

These Terms are governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, United States, without regard to its conflict of law principles.

Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will revise the Effective Date and may provide additional notice when appropriate.

Your continued use of HabitHone after updated Terms become effective constitutes acceptance of the updated Terms.
